As of October 9th 2019 the USTR (Office of The United States Trade Representative) Announced Additional Product Exclusions for Section 301, China Trade Action

Prior to these dates (September 20th and October 2nd  2019) the Office of the United States Trade Representative (USTR)  had announced in the Federal Register (FR) additional rounds of tariff exclusions for certain products from China under Section 301 of the Trade Act of 1974. Importers will no longer have to pay additional duties on specified products.

The new product exclusions are conditional, available for any product that meets the description as set out in the annexes of the FR Notices, and are retroactive back to their respective effective dates. This is regardless of whether the importer filed an exclusion request.

For reference, below is a complete list of product exclusions issued under Section 301.

Before today there has been a total of five (5) Section 301 Tariff exclusions released by the Office of the U.S. Trade Representative (USTR) between Sept. 20 and Oct. 2, 2019.

SEPT. 20 Exclusion Lists

The USTR released three notices granting additional exclusion requests to the Section 301 duties levied on goods from China. The notice affects goods on Lists 1, 2 and 3 specified in the Annex attached to each notice. A link to each USTR notice follows:

Importers who wish to request an administrative refund for previous imports of duty-excluded products granted by USTR may file a Post Summary Correction (PSC) following the entry filing instructions in the FRN. If the entry has already liquidated, importers may protest the liquidation.

If FTN made the entry for the FXE shipment: customers will need to use the established D&T protest process to arrange for the PSC or to protest the liquidation of the entry.

If the shipment was imported under BSO: the customer needs to coordinate the PSC or protest with the broker who cleared their shipment.
